Welcome to Homlyn. "We," "us," and "our" refer to Homlyn. We operate this store to provide you with a curated shopping experience, powered by Shopify. We make every effort to accurately represent our products, but colors or appearance may differ from your screen depending on your device and settings. We don't warrant that a product's appearance or quality will match how it's depicted online.

Placing an order is an offer to purchase. We reserve the right to accept or decline your order for any reason at our discretion — it isn't accepted until we confirm it, and we must receive and process payment first. Purchases are subject to return or exchange solely under our Return Policy. You represent that your purchases are for personal or household use, not for commercial resale or export.

4. Prices & billing

Prices, discounts, and promotions may change without notice. The price charged is the one in effect when the order is placed, shown in your confirmation email. Posted prices exclude taxes, shipping, handling, customs, or import charges unless stated otherwise.

We're not liable for shipping and delivery delays. All delivery times are estimates only and not guaranteed. We're not responsible for delays caused by carriers, customs processing, or events outside our control. Once products are transferred to the carrier, title and risk of loss pass to you.

Homlyn is powered by Shopify, which enables us to provide the Services to you. Any sales you make are made directly with Homlyn — Shopify is not responsible for any aspect of these sales, including injury, damage, or loss from purchased products. You release Shopify and its affiliates from claims, damages, and liabilities related to your purchases and transactions with Homlyn.

10. Privacy policy

All personal information we collect is subject to our Privacy Policy, and certain information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge you've read both.

Because the Services are hosted by Shopify, Shopify collects and processes information about your access and use of the Services to provide and improve them. Information you submit may be shared with Shopify and third parties, potentially in other countries, in order to provide services to you.

WE DO NOT GUARANTEE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE USE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMLYN, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND SHOPIFY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, REVENUE, SAVINGS, OR DATA — ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

18. Indemnification

You agree to indemnify, defend, and hold harmless Homlyn, Shopify, and our respective affiliates, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — arising from your breach of these Terms, your violation of any law or third-party right, or your access to and use of the Services.

We'll notify you of any indemnifiable claim; we may control the defense and settlement at your expense, but won't settle claims requiring non-monetary obligations from you without your consent. You agree to cooperate in the defense, including by providing relevant documents.

19. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, it will still be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed — without affecting the validity of the remaining provisions.

20. Waiver; entire agreement

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Homlyn is headquartered, and you consent to venue and personal jurisdiction in the courts of that jurisdiction.

Headings in this agreement are included for convenience only and do not limit or otherwise affect these Terms.

You can review the current version of these Terms at any time on this page. We may update, change, or replace any part of these Terms at our sole discretion by posting changes to our website — it's your responsibility to check periodically. We'll notify you of material changes where required by law, and continued use of the Services after changes are posted constitutes acceptance of them.
